The Collapse of the 28-Article Peace Initiative for Ukraine: How Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the crisis caused by the introduction of a new 28-article proposal for resolving the conflict appeared – temporarily – to have been defused. A senior US official spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its retaliation: another massive barrage of aerial bombardment on Kyiv.

The Pattern of Peace Talks and Military Action

The sequence of opposing developments captured the grim essence of the outgoing year. By day, negotiation efforts are fought: hopeful statements are released from various governments. Considerable effort is expended on managing specific proposals. By night, the Kremlin clearly shows the world that, for them, conflict continues to be the main instrument for achieving "settlement".

Nighttime Reality

As the offensive progressed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was laid bare. Ukraine is capable of detecting rocket firings from enemy soil, a capacity afforded by current data. From witness perspectives, Ukrainian air force fighter jets that had been dispatched to counter approaching cruise missiles streaked across the sky – modern combat jets supplied to Ukraine by Western partners.

Soon thereafter, Kyiv's air-defence systems activated: several firings fired to intercept a Russian ballistic missile. This was a sophisticated defense system at work, probably delivered by Western nations. Every launch jolts you unexpectedly, shaking the windows. The moment of terror quickly transforms into grim resignation: possibly the incoming missile won't cause damage this time, protecting urban areas from catastrophe and further power outages.

Continuous Dangers

Not long after, a automatic firearm engaged a unmanned aircraft close by, part of a mobile-fire group – almost certainly imported technology. Regrettably, the shots failed to hit the enemy aircraft – it continued its flight toward its target.

Intermittently, this persisted until dawn. Kyiv faced the daybreak reports: multiple fatalities, devastation and utility failures in numerous residences as a result of the nocturnal offensive. As customarily, everyone still maintained normal activities – experiencing conflict. But those 24 hours encapsulated Ukraine's essential dependence on Western support – a dependence that European nations are evidently unprepared to fill in the short term.

Ineffective Peace Efforts

The 28-point plan from US administration generated strong feelings, controversy and serious worry – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after earlier high-level meetings and multilateral gatherings.

Every new proposal from Washington adheres to the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, effectively counters. They stabilise the situation but never actually secure success. This pattern will, undoubtedly, endure.

Strategic Calculations

It is tempting to accuse specific actors of consistently pushing Kremlin's demands. But that does not seem to be the entire situation. American leadership functions according to a principle understood by experienced diplomats: you cannot win at the negotiating table what you have lost on the battlefield. The White House assumes that it is unrealistic to pressure the Kremlin to relinquish the territory that it currently occupies in Ukraine's southern or eastern regions.

The problem is that while recognising this factual reality, American administration does little to deter Moscow, through statements or actions, from assuming that the current condition will not change more in its favour in the near future.

Opposing Positions

Therefore, Russian leadership is certain that time is on his side – that Ukraine and its supporters are coming close to fatigue. Their reason to accept conditions that does not give them the largest achievable advantage is virtually nonexistent. There may be numerous efforts to achieve ceasefire, but they will continue as long as Russia's government remains supremely confident in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still endure, gradually sacrificing lives and land but avoiding a complete military breakdown until conditions improve in its advantage.

Current Realities

Objectively, there are no genuine requirements for a ceasefire. Now, personal considerations are coming into play: political desires to negotiate peace and obtain worldwide acknowledgment, and Kyiv's double obstacles – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the country's interests against any plan Kyiv finds unacceptable, so that their priority does not switch to domestic problems. And although their mission will now be much harder after latest incidents, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are driving the talks.

Summary and Prospects

It took a just a single week to terminate the suggested clauses of the current initiative. Aggressive and erratic handling of the matter by US administration, pushback by Ukraine and the rest of Europe, along with calming attempts of representatives, and finally, current information leaks, all achieved their purpose.

While new initiatives based on previous concepts are approaching, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are founded on Moscow's terms and show certain reluctance to modify developments, if they maintain solidarity and improve their protective measures at a much faster pace. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the predictable period, primarily depend on sustained allied backing.
